How do Australia and New Zealand rate for setting up trusts?

Asked in Trusts for New Zealand

We have heard that we can set-up trusts in New Zealand and Australia, and don’t have to register the trusts – is that correct?

How would you rate these jurisdictions?

Can anyone kindly let us know about the trust legislation strengths and weaknesses of these jurisdictions?

Thank you.

Your source is not reliable...

Australian trusts need to be registered.

Same for Kiwis trusts, which must fill annual returns (both trustees and beneficiaries).

I would rate them low, considering:
* investments opportunities there, including access to financial markets, non ability to deal with non-residents.
* statutory limitation of 80 years (you can find perpetuity jurisdictions out there).

Thank you for the fantastic information prominee.com. You are an encyclopedia of knowledge!

I am particularly concerned about the following points you rightfully flag up:

"investments opportunities there, including access to financial markets, non ability to deal with non-residents."

Could you kindly clarify how these may affect us?

Could our trust deal with non-Australian/NZ residents/businesses? We were specifically intending to open up share dealing accounts in somewhere such as Singapore or Hong Kong to invest the funds held in the trust (or in AU/NZ themselves, if that is a better option). Do AU and NZ have the set-up to not tax foreign investments held in trusts, like many other jurisdictions do?

Thanks a million.

prominee.com - Could you kindly clarify how these may affect us? Could our trust deal with non-Australian/NZ residents/businesses?>>> My comment was about the ability of the operators in Australia or New Zealand. They are not known for their ability to deal with foreigners, because they are not really offshore jurisdictions. Commented on Aug 22, 2014 at 07:08

BEWARE: Do not use most of all these Private Money Lender here, there are not genuine and trustworthy mostly if they have a free email account i.e. yahoo, gmail, hotmail, live etc, that should arose your suspicion and be very cautious. If they have telephone number with international dialing codes from Nigeria (Africa ) & India then you have to beware. A genuine lender would have a legitimate website, personalized email address/account and not a free email account. I recommend anyone looking for a trusted/relaible lender to visit: CHESHIRE LOAN COMPANY LTD BASED IN THE UK & USA their credibility speaks for them far more in the industry than other lenders whom put up advertisement here to lure loan seekers out of their hard earned money. Contact CHESHIRE LOAN COMPANY LTD for your Business & Personal Loan, Mortgage Loans, Debt Consolidation and Real Estate Loans.
