Footnotes

  1. A 3% education cess is levied on payments subject to withholding tax paid by an Indian company. A further 2% surcharge applies to payments over INR10m paid to a non-resident taxpayer (5% for a resident taxpayer). The surcharge and education cess will not apply where the withholding tax rate is limited by a tax treaty.
  2. India's default dividends withholding tax rate is 0%. However, a dividend distribution tax is payable at a rate of 16.22% by the company paying the dividend.
  3. The treaty has a most favoured nation clause which redues the royalty rate to the lowest rate in all of Inida's treaties with other OECD countries.
  4. The domestic rate applies.
